What is an NGO?

Non-governmental organizations (NGOs) are corporations that are legally constituted by 

natural or legal ‘people’ (such as an incorporated company). An NGO runs independently from any form of government, even if funded by a government.

NGO’s are not customarily for-profit businesses.

Setting up an NGO in South Africa

The first step will be to register your NGO:

Ø You will need to complete and submit your completed NPO application form to the appropriate (closest) provincial social development office. As well as your application you will need to submit two copies of:

ü Your deeds of trust and letter of authorisation from the courts;

ü Your Section 21 Certificate of Incorporation and Memorandum of Incorporation;

ü The Constitution of your Voluntary Association.

Recruiting or transferring foreign staff when setting up an NGO in South Africa

Many make the mistake of thinking that a business visa is the most likely option as they are in fact setting up a non profit business. However South Africa’s immigration rules do not cater directly for Setting up an NGO in South Africa so the set up and the recruitment of any needed foreign staff must be looked at separately.

Permit and visa options for when your NGO is set up

There are 3 basic options for the hiring of staff for an NGO:

Where the foreign employee is also a shareholder in the business, the shareholding must be minimal otherwise none of the above visa can be applied for.
