Information

Membership: WIPO and Paris Convention;

Classification: 8th Edition of the Nice Classification applies. However, Iraq separated each class into sub-classes;

Coverage: A SEPARATE APPLICATION should be filed for each class. An application could cover MULTIPLE SUB-CLASSES;

Rejection: Must be appealed within 60 days;

Publication: In 3 consecutive issues of the Gazette;

Opposition: 60 days as from the last publication date;

Time Frame: 16 to 24 months from the filing date;

Duration: 10 years as from the filing date;

Renewal: For unlimited periods of 10 years each;

Grace Period: None;

Penalty: None;

Assignment: Possible;

Licensing: Possible;

Invalidation: Yes, if the mark has not been used for 5 consecutive years.

Ø Power of Attorney legalized to the Consulate of Iraq;

Ø Applicant’s name, address and nationality;

Ø List/s of goods and/or services;

Ø Representation of the mark, preferably in jpeg format;

Ø If priority is claimed, a certified copy of home application/registration.

Ø A copy of the existing Certificate of Registration.

ASSIGNMENT

Ø Translation of up to 100 words of the List/s of Goods/Services (Each additional 50 words or part thereof will be charged for US$50.00).

C) We bill filing charges when the application is filed, while the balance will be billed upon acceptance.
