The trademark is anything which takes a distinctive form such as words, signatures, letters, figures, devices, brands, headings, seals, drawings, engravings, pictorial elements, color combinations, any sign that is perceivable by sight, audio signs and signs related to the sense of smell or any other mark or combination of marks, when used or intended to be used to distinguish goods or products, to indicate that they belong to the owner of the mark, by reason of manufacturer, selection, trading in or offering for sale such goods or products. 

Classifications 
Kuwait follows International Classification of Goods and Services for the Purposes of the Registration of Marks under the Nice Agreement Goods from classes IC 1-34, while Services are in IC 35-45. The trademark law does not provide for the protection of trademarks covering alcoholic drinks in classes 32 and 33 and pork meat in class 29. Class No. 33 has been completely dropped and the international class 34 has been reinstated for tobacco products. A separate application should be filed with respect to each class of goods and services.

Examination & Refusal on absolute and relative grounds 
Trademarks Office has had legal power to refuse an application on specific ground: for the purposes of the Law, the “mark” filed are not considered to be able to be a “trademark” for one of the following reasons. 
1,Formal reasons 2, lack of distinctiveness or descriptiveness 3, Public policy 4, Immortality 5, Resembles to an official symbol 6, resembles of a national flag 7, resembles to surname 8, resembles to a Geographical name or indication 

Trademark office also have the right to reject a trademark on “relative grounds” The trademark identical or similar to an extent raising a confusion towards famous trademark or trade name in the State of Kuwait or constitutes a translation for it regarding the identical or similar goods or services of other project or to an application prior to the application of registering the concerned trademark as regards the date of filing or priority date in relation to the same goods or services or goods or services closely connected therewith or if they are similar to a degree that causes confusion or misleads. 

Opposition 
When the Registrar accepts a trademark, he shall, before registration, publish it in three consecutive issues of the Official Gazette. Any person interested shall be entitled, within thirty days as from the date of the last publication, submit to the registrar a written notice of his opposition to registration. 

The Registrar shall send, by registered mail, a copy of the notice of opposition to the applicant or his agent who shall, within 30 days from the receipt thereof, send to the Registrar a written counter statement (in duplicate) of the grounds on which he relies for his application, and, if he does not do so, he shall be deemed to have abandoned his application. 

Appeals against Decision of the Office Decision

Any decision of the trademark Registrar’s Office can be appealed and the same be lodged before a Court within 10 days from notification of the Register’s decision and the appellant must engage a local Attorney to contest his case.

Renewal 
The protection period which the registration of a trademark entails, shall be ten years. The owner shall secure renewal of the protection for further terms if he submits an application for renewal during the last year of protection. The applicant also allow to renew the mark during six months grace period with a fine.

Amendment of registered mark
The proprietor of a registered mark may apply for the entering of the following in the Register:
a) Change of name, surname, occupation and nationality of proprietor, and, where a company is concerned, the changes in name, style and objects;
b) Crossing off certain goods or products for which the mark is allocated;
c) Any change of address to which correspondence and documents are forwarded or of the location wherein lies the firm or enterprise for the distinction of the products of which the mark is used; 

Penalties 
The Law provides for penalties to protect the trade descriptions and trade marks. There are two kinds of penalties: criminal and civil.
The criminal penalty provides for imprisonment up to a period not exceeding three years and a fine not exceeding Six hundred Kuwaiti Dinar or either such penalty, for: falsifying, imitating or using a registered trade mark, knowing it to be falsified or imitated; using, in bad faith, a mark owned by others; dealing in products bearing falsified or imitated marks or marks unlawfully placed thereon knowing them to have been so placed; any infringement of the provisions of the aforesaid trade descriptions.

The civil punishment consists of a suit instituted by the owner against the infringer.
The rightful owner may, even before instituting civil or criminal proceedings, obtain an order from the judge, competent to hear either suit, for seizure of the tools used in the commission of the offence, as well as the products on which the trade mark or trade description had been placed. The civil or criminal action shall be instituted within eight days from the date of affecting the aforesaid seizure. The civil or criminal Court may order the forfeiture of the seized things for the purpose of deducting the price thereof from the damages awarded and fines or for the purpose of disposing thereof by any other method as the Court may deem expedient; it may order the destruction of the unlawful marks and products bearing such marks or unlawful descriptions and to destroy the means used for the falsification, even when the verdict is one of acquittal. The Court may order the publishing of the judgment in the Official Gazette at the expense of the convicted person.

Merger Applications 
1. A Power of Attorney - legalized up to the Kuwaiti Consulate.
2. A merger document legalized up to the Kuwaiti Consulate.
3. The original Kuwaiti certificate of the trademark for recording new protection period. 

Assignment of a Registration 
1. A Power of Attorney - assignee legalized up to the Kuwaiti Consulate. 
2. A deed of assignment with or/without goodwill signed by both parties and legalized up to the Kuwaiti Consulate. 
3. The original Kuwaiti certificate of registration for endorsement purposes.

Change of Name/Address Applications
1. A Power of Attorney in the new name and/or address legalized up to the Kuwaiti Consulate.
2. An official certificate or simple declaration proving the change of name and/or address legalized up to the Kuwaiti consulate.
3. The original Kuwaiti certificate of registration of the trademark for endorsement purposes.

Cancellation of Registration 
1. A Power of Attorney from the applicant with mark specifications legalized up to the Kuwaiti Consulate.
