Search for a trademark

The Trademarks Register contains all trademark applications and registrations that are valid in the Benelux countries. In addition to Benelux trademarks, this includes Community (i.e., European) trademarks and international trademarkswhich designate the Benelux.

In the Trademarks Register you can monitor the status of your own applicationsand registrations, and check out existing trademarks held by other parties.

NB. If a trademark does not appear in the Trademarks Register, that does not automatically mean that it is available. 

Other registers

If you wish to know whether your trademark has also been registered outside the Benelux, various options are open to you. You can search in the World Intellectual Property Organization (WIPO) database, in the database of the Office for Harmonization in the Internal market (OHIM), in the database of the country in question or in TMView

TMView is a free online information instrument. The information held in TMView is provided by the official trademarks offices of the various European countries. They own the content and are responsible for keeping it up to date. Information held in the databases of OHIM and WIPO is also accessible via TMview. On the TMView website you can see which European countries currently make their data available via TMView.

Copies

The Trademarks Register also serves as the official publication for Benelux trademarks. This means, among other things, that many authorities will accept copies from the Register as proof of your application or registration. You can produce a copy yourself (free of charge) by clicking on "Print". If you still need a certified copy (for a charge), just click on "Order".

Register a trademark

Apply directly online

You can apply to register and protect a trademark by filing the brand name and/or logo online. You can also register a trade name or company name as a trademark. 

The Benelux Office for Intellectual Property (BOIP) is the official body for trademark registration in the Benelux. A standard 10-year trademark application costs 240 euro. The procedure for definitive trademark registration takes about 4 months.If your trademark cannot be registered after all, the filing fees will not be refunded. You can also accelerate the registration of your trademark upon payment of an extra fee.

The registration is valid for a period of 10 years. Your trademark will be protected for the duration of this period. You can then renew your registration at the end of the 10-year period.To maintain the right to your trademark you need to use it actively.

Registering a trademark on paper

You can also register your trade name, product name or logo as a trademark by filling out the paper form. The costs for a trademark application on paper are 15% higher than those of an online application. You can print out the form, along with the explanatory notes. Send the completed form to us by post or fax, or hand it in to us in person.

Registration procedure

Registration and publication

If your application fulfils all the legal requirements, the BOIP will enter it into the register. This procedure lasts approximately 3 months. However, if opposition is filed against your application or a refusal on absolute grounds is pronounced, the period can obviously last (much) longer and it will then be uncertain whether your trademark can be registered at all. Please note that if your trademark cannot be registered after all, the filing fees will not be refunded. This is all the more reason for you to make inquiries in advance about the potential risks, or to seek advice from an expert. 

As of the registration date, you will be the holder of an exclusive right that you can invoke against others. The filing date will, however, be key to determining which trademark has the oldest right in the event of a conflict.

You will receive a certificate of registration, and the number and the registration date will also be shown in the Trademarks Register.

Receipt of application

When your application has been received, the BOIP makes a note of the date and time of receipt, of which you will receive confirmation. The data you have stated on the form is then entered into our system. From that moment on you will be able to monitor the status of your application in the Trademarks Register.

First of all, a check will be carried out to see whether your application complies with the minimal requirements:

Is the trademark clearly represented?

Is there a reference to the name of the applicant (person orcompany)?

Are the goods and services clearly described?

In the event of a collective trademark, have regulations for use and control been included?

These are the minimum requirements that have to be fulfilled; if they are not, your application is inadmissible. In other words, no application is deemed to have taken place.

The filing date is set at the date on which these requirements have been fulfilled. However, payment also has to be made. Once we have received your application we will send you a payment summary as soon as possible. NB. Even if you do not receive this summary, it is very important that the BOIP receives your payment of the required fees within one month. Otherwise, the filing date will be postponed to the point in time at which we receive your payment.

The filing date is important for determining priority as regards your trademark and the rights of others.

Accelerated registration

You can accelerate the registration of your trademark upon payment of an extra fee. Sometimes situations arise in which a trademark has to be registered quickly: for example if you want to invoke your trademark against someone who infringes your rights or if you want to arrange international protection of your trademarks, which in certain cases has to be based on a basic registration in the Benelux.

In the event of an accelerated registration, the trademark will be registered as soon as the formalities have been attended to. This procedure can be completed within a couple of days. You should note, however, that the assessment on absolute grounds and any opposition will, in this case, take place after registration. This may still lead to your registration being cancelled and deleted from the register.

Opposition against application

Once your application has been published, opposition can be filed within two months. Opposition is a procedure whereby the holder of an older trademark can submit an objection with the BOIP against the registration of a more recent trademark. 

Both parties are first given the opportunity to resolve their conflict mutually. If that fails, the BOIP takes a decision, but only after both parties have been able to exchange arguments. This can either be a rejection of the opposition, or (if the opposition is found to be legitimate) a refusal to register your trademark. An appeal can be made against the BOIP's decision before the courts of appeal in the Hague (Gerechtshof), in Brussels (Hof van Beroep or Cour d'appel) or in Luxembourg (Cour d'appel).

Publication of application

Once the filing date has been determined, your dossier will become the responsibility of one of our members of staff. He or she will check whether all the formal requirements have been fulfilled and contact you if any additional further details are required. The goods and services referred to will then be arranged into classes in accordance with the international Nice classification. 

Once the filing date has been determined and the goods and services have been correctly classified, the application will be published. You will receive a confirmation of the publication of your application. The details and the publication date will be published on the Trademarks Register. Publication is really the start of the substantive procedure.

Maintain a trademark

The exclusive right to a trademark exists once the BOIP has registered your application. Your trademark will be published in the official Benelux Trademarks Register.You will receive a certificate of registration. Once your trademark is registered you can take action against infringements (counterfeiting and piracy).

You can take action not only against subsequent Benelux trademarks, but also against all trademarks valid in the Benelux territory, i.e. including Community trademarks and International trademarks that are valid in the Benelux territory.

In order to maintain this exclusive right you must use it, monitor it, keep it up-to-date and renew your registration in good time.
