Trademark Registration in Paraguay: Requirements and Procedure

Trademark registration requirements in Paraguay:

Ø Power of attorney certified by a Notary Public and legalized in your country before the Consulate of Paraguay. 

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number). 

Ø Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Paraguay:

The opposition period is within 60 days following publication. The registration procedure lasts 18 months. The protection lasts 10 years from the filing date.

Other trademark procedures in Paraguay:

Trademark renewal in Paraguay: The trademark renewal may be done within 6 months before expiry. For the trademark renewal we need the power of attorney legalized. After trademark renewal the protection lasts 10 years.
Trademark changes in Paraguay: For changing the name or the address we need the power of attorney duly legalized and an official document certifying change of name, legalized.
Trademark assignment and trademark license in Paraguay: For the trademark assignment we need the assignment document legalized. Please be informed that pending applications may be assigned, but unregistered marks may not be assigned
Trademark use in Paraguay: When a registered mark has not been continuously used for the goods or services concerned for 5 years from the date of registration (or the date of the last use), a cancellation action may be filed by an interested person.
