Trademark Registration in Algeria: Requirements and Procedure

Trademark registration requirements in Algeria:

Ø Power of attorney simply signed, indicating the full name and position of the person who signs the POA.

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The details of goods and/or services for witch the trademark will be registered or the classes in case they are known. 

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number). 

Ø Certified copy of priority document in case priority is to be claimed.

All the documents must accompany the application when it is filed.

Trademark registration procedure in Algeria:

The time frame from filing the application until obtaining the certificate (not including incidental actions such as opposition, etc.) is 24 months. The national registrations in Algeria are valid for ten years . The term is renewable for unlimited times, each of 10 years.

Other trademark procedures in Algeria:

Trademark renewal in Algeria: The power of attorney can be filed within 2 months from the filing date of the trademark this period may be extended by another 2 months on motivated request). This is applicable to all acts and the receipt of all notifications, with the exception of the withdrawal of Brand or renunciation. A proof of usage the trademark in Algeria in the year preceding the deadline (or the signature of the declaration of use), this document should be submitted within 2 months. The renewal is possible within the last 6 months from expiration date, with a penalty cost. For the renewal we need the power of attorney, simply signed.
Trademark change in Algeria: For changing the name or the address we need a simply signed power of attorney, certificate of change of name, notarized and number and date of the registered trademark. 
Trademark assignments in Algeria: For the assignment we need the power of attorney (English/French), signed by the new owner and should include the name and the capacity of the signatory. The assignment deed has to be signed by all the parts and must be legalized by the Algerian consulate or embassy.
