Trademark Registration in Botswana: Requirements and Procedure

Trademark registration requirements in Botswana:

Ø Power of attorney simply signed. 

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number).

Ø Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case.

Trademark registration procedure in Botswana:

The trademark registration procedure lasts 36 months. The trademark is published, after it is accepted, in the Journal. The opposition period is 3 months. The protection lasts 10 years from the filing date.

Trademark renewal in Botswana No documents are needed. The renewal may be done within 6 months before expiry. For the renewal we need the legalized power of attorney and the last registration certificate. The trademark protection lasts 10 years.
Trademark changes in Botswana: For changing the name or the address we need the power of attorney simply signed. Certificate of change of name and address, with verified English translation 
Trademark assignments and license in Botswana: For the assignment we need the power of attorney signed by the assignee. An assignment deed signed and stamped by both parties. Trademark assignments and license in Botswana may be done with or without Goodwill. Pending applications and unregistered marks may be assigned. For the license we need the power of attorney simply signed from proprietor and licensee and license agreement with verified English translation 
Trademark use in Botswana: The non-use for 3 years makes the registration vulnerable to cancellation
