Trademark Registration in Democratic Republic Of Congo (Formerly Zaire): Requirements and Procedure

Trademark registration requirements in Democratic Republic of Congo:

Ø Power of attorney simply signed and stamped must be submitted in duplicate. 

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known. Congo adopts the multi-class filing system. In Congo the International classification of goods is adopted. Here is not possible to file service marks.

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number).

Ø Information related to the previously filed trademarks, in order to benefit of the priority date, if it is the case. In case that priority is claimed, the certified copy of the priority document will be filed simultaneously with the application.

Trademark registration procedure in Democratic Republic of Congo:

There is no opposition period. The registration procedure lasts 24 months. The protection lasts 10 years from the filing date.

Other trademark procedures in the Democratic Republic of Congo:

Trademark renewal in Democratic Republic of Congo: The trademark renewal may be done within 12 months before expiry with grave period of 6 moths after payment of penalty. For the trademark renewal we need the power of attorney in duplicate simply signed and stamped and the original certificate of registration for endorsement. After trademark renewal the protection lasts 10 years.

Trademark changes in Democratic Republic of Congo: For changing the name or the address we need the power of attorney in duplicate simply signed and stamped, the certificate of change of name duly notarized and the original registration certificate for endorsement purposes.

Trademark use in Democratic Republic of Congo: When a registered mark has not been used for any period of 3 consecutive following registration, a cancellation action may be filed.

ü 2 prints of the trademark

ü The full particulars of the applicant

ü The list of the goods and/or services to be covered by the trademark and classes.

ü Priority document with certified French translation

Granting:

The protection is for ten years, and starts from the date of application

Renewals:

Every ten years
