Trademark Registration in Malawi: Requirements and Procedure

Trademark registration requirements in Malawi:

Ø Power of attorney which must be signed by an authorized representative of the instructing client, and the signature thereto must be notarized. 

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number).

Ø Certified copy of priority document in case priority is to be claimed.

Ø Statement of whether the trademark is used or proposed to be used in Malawi.

Trademark registration procedure in Malawi:

The registration procedure lasts 2 months. After the application is accepted it is published in the Patent and Trademarks Journal. After the trademark is published, the opposition can be filed within 2 months. The protection lasts 7 years from the filing date.

Other trademark procedures in Malawi:

Trademark renewal in Malawi: The renewal may be done within the 6 months before expiry. For the renewal we need a power of attorney simply signed. After renewal, the protection lasts 14 years.

Trademark changes in Malawi: For changing the name or the address we need a simply signed power of attorney and the document certifying the change of name. 

Trademark assignments in Malawi: For the assignment we need the power of attorney simply signed by the assignee, the deed of assignment signed by both parties. .Assignments may be done with or without Goodwill. Pending applications may not be assigned. Unregistered marks may be assigned, but only if it is used in the same business as a registered mark and to the same person as the registered mark.

Trademark use in Malawi: 

Non-use for 5 years following registration makes the registration vulnerable to cancellation; it is possible 

to file an intent-to-use application in the Malawi.

Renewals:
for periods of 14 years
