Trademark Registration in Sudan: Requirements and Procedure

Trademark registration requirements in Sudan:

Ø Power of attorney simply signed is valid for 5 years.

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark)

Ø The details of goods and/or services for witch the trademark will be registered or the classes in case they are known (one application should not cover all the goods in one class). 

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number). 

Ø Certified copy of priority document in case priority is to be claimed, 

Ø Extract from the commercial register or certificate of incorporation legalized up to the Sudanese Consulate.

Trademark registration procedure in Sudan:

The registration procedure lasts 24 months. The trademark will be published after the acceptance in the Official Gazette. The opposition can be filed within 8 months. When the application matures into registration, the Registrar requests a simply signed declaration on the applicant’s letterhead paper stating that the applicant did not change their legal entity, name or address. The protection lasts 10 years from the filing date.

Trademark renewal in Sudan:The trademark renewal may be done within 2 - 3 months before expiry date. For the trademark renewal we need the signed power of attorney legalized up to the Sudan Consulate, the trademark registration number and class of goods and the date of expiration of the trademark registration. After renewal the protection lasts 10 years.
Trademark change in Sudan: For the change of name or address we need the power of attorney legalized up to the Sudan Consulate, the certificate of change the name/address legalized up to the Sudan Consulate and the registration certificate for endorsement. 
Trademark assignment in Sudan: For the trademark assignment we need the power of attorney legalized up to the Sudan Consulate, the deed of assignment legalized up to the Sudan Consulate, the trademark certificate of registration for endorsement purposes and the extract from the commercial register or certificate of incorporation of the assignee legalized up to the Sudan Consulate. 
Trademark agency agreement in Sudan: For the trademark agency agreement we need the power of attorney legalized up to the Sudan Consulate, the agency agreement executed by the Principal and the Agent legalized up to the Sudan Consulate and the certified copy of the certificate of incorporation of the licensee legalized up to the Sudan Consulate.
Trademark license in Sudan: For the trademark license we need the power of attorney legalized up to the Sudan Consulate, the certified copy of the license agreement legalized up to the Sudan Consulate abroad, the date of executing the agreement should not exceed 6 months, the certified copy of the certificate of incorporation of the licensee legalized up to the Sudan Consulate. An approval letter from the Sudanese Ministry of Industries to the licensee may be requested.
Trademark use in Sudan: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
