Trademark Registration in Australia: Requirements and Procedure

Trademark registration requirements in Australia:

Ø No power of attorney is required. 

Ø Design of the trademark in JPEG format in case of a graphical trademark (not required for word mark).

Ø The detaliation of goods and/or services for witch the trademark will be registered or the classes in case they are known.

Ø Details of the trademark owner (name, address, registration number).

Ø Invoicing details (name, address, fiscal number, registration number).

Ø Information related to the previously filed by you trademarks, in order to benefit of the priority date, if it is the case.

Trademark registration procedure in Australia:

The trademark registration procedure lasts from 12 to 18 months from the filing date. 
The opposition period is 3 months from publication in the Official Gazette. 
The protection period is 10 years from filing date. The time until issuance of registration certificate is 7 months.

Other trademark procedures in Australia:

Trademark renewal in Australia: The trademark renewal application must be filed within 12 months before expiry. For the request of the renewal the forms must be signed by the applicant.
Trademark changes in Australia: For changing the name we need the official document certifying the change of name and the original certificate registration. 

Trademark assignments in Australia: For the assignment we need the assignment deed and the certificate of registration. Trademark assignment may be done with or without Goodwill. Pending application and unregistered marks may be signed.

Trademark use in Australia: Lack of intention to use in good faith or non-use for 3 years following 

registration makes the registration vulnerable to cancellation.
