VANUATU: New Trademark Legislation

Vanuatu (officially known as the Republic of Vanuatu) recently updated its trademark legislation. The Registration of UK Trade Mark (Amendment) Act No. 15 was passed on July 7, 2008. 

The Act makes two major amendments to Vanuatu’s trademark legislation. 

Basis of Applications Extended 

Given the worldwide influence of the Community trade mark (CTM) and Madrid regimes, the Vanuatu government has amended its trademark legislation to allow for broader recognition of trademark registrations secured throughout the European Union. 

Previously, trademark owners could file a Vanuatu trademark application only if the application was based on a current UK registration. But CTM registrations or Madrid registrations extended to the United Kingdom could not form the basis of a trademark application in Vanuatu. 

Vanuatu’s updated legislation now allows trademark owners to base their Vanuatu trademark applications on: 

• a trademark registered in any member state of the European Union; or 

• a trademark registered under any treaties to which a member state of the European Union may be a party. 

The amendment means that Vanuatu trademark applications can now be based on CTM registrations and national registrations achieved in the European Union under the Madrid System. 

Applications Can Now Cover Services 

The Vanuatu trademarks registry previously had allowed trademark owners to file trademark applications in Vanuatu covering services, but there was no provision in the Act to allow trademark registrations in relation to services. Now, the amended legislation clearly allows trademark owners to register trademarks covering services in Vanuatu. 

Other Similar Legislation 

Several Pacific Island nations have trade mark laws that are similar to Vanuatu’s legislation prior to these amendments. It is hoped that these countries will follow Vanuatu’s lead by amending their trademarks legislation.
